By accessing or using the Website, you agree to these Terms. If you do not agree to these Terms, do not access or use the Website.

Participants in the Phone Actress program operate as independent businesses or independent contractors, subject to separate agreements and approval requirements. Any application, onboarding, approval, payment, or service relationship will be governed by the applicable agreement signed or accepted by the participant, not by these Terms alone.

Use of phrases such as “work,” “job,” “team,” or similar language on the Website is for general marketing convenience only and does not create an employment relationship, partnership, joint venture, agency relationship, franchise relationship, or any other legal relationship except as expressly stated in a separate written agreement.

No Website content shall be interpreted as creating, offering, or implying employment, employee benefits, minimum compensation, scheduled work, supervision, control over work hours, or any right to receive assignments, caller traffic, customer traffic, or business opportunities.

If the parties cannot agree, a court of competent jurisdiction shall appoint the arbitration provider or arbitrator.

The arbitration must take place in Las Vegas, Nevada, unless the parties agree otherwise. The arbitrator will have exclusive authority to resolve all disputes relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of this arbitration agreement is void.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

  • Injunctive Relief

Either party may seek temporary, preliminary, or permanent injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property, confidential information, account security, system security, or other rights that may be harmed absent immediate relief.

  • Class Action Waiver

All disputes must be resolved only on an individual basis. You and Phone Actress each waive any right to bring or participate in any class action, collective action, representative action, private attorney general action, or consolidated proceeding.

The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. The arbitrator must not preside over any class, collective, representative, consolidated, or private attorney general proceeding.

  • Jury Trial Waiver

To the extent permitted by law, you and Phone Actress each waive the right to a trial by jury in any dispute arising out of or relating to these Terms, the Website, or your access to or use of the Website.

  • Time Limit to Bring Claims

To the extent permitted by law, any claim arising out of or relating to these Terms or the Website must be brought within one year after the claim accrues, or it will be permanently barred.

  • Arbitration Severability

If any part of this arbitration agreement is found unenforceable, the unenforceable part will be severed and the remainder will be enforced to the fullest extent permitted by law.

If the class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request for relief may proceed in court only after arbitration of all arbitrable claims is completed.

  1. Venue for Non-Arbitrable Claims

For any claim not subject to arbitration, the exclusive jurisdiction and venue will be the state or federal courts located in Las Vegas, Nevada. You and Phone Actress consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum or improper venue.

  1. Termination

We may suspend, restrict, or terminate your access to the Website at any time, with or without notice, if we believe you have violated these Terms, created risk for us or others, submitted false information, engaged in unlawful conduct, or used the Website in a manner inconsistent with its purpose.

Upon termination, your right to access and use the Website will immediately cease.

These Terms, together with any policies or notices incorporated by reference, form the entire agreement between you and us regarding your use of the Website.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full effect.
